Methods of Service for Eviction Notices (CCP § 1162)

California Code of Civil Procedure § 1162 specifies three permissible methods for pre-suit tenancy notices:

1. Personal delivery directly to the tenant;
2. Substituted service — leaving a copy with a person of suitable age and discretion at the residence or place of business and mailing a copy to the residence; or
3. Posting and mailing (“nail and mail”) — affixing a copy in a conspicuous place on the property and mailing a copy by first-class mail when no suitable person can be located at home or work.

Unlawful Detainer Summons Service

Unlike a 3-Day Notice, an Unlawful Detainer Summons (Form SUM-130) cannot be served by posting without first submitting a Declaration of Due Diligence and obtaining a signed judicial order under CCP § 415.45.
